Jayson L. Cohen
Two decades of wins for his clients – in court, before the FCC, and at the negotiating table
PARTNER
Based in New York City, Jayson is a trial lawyer and space attorney. Corporations have relied on his roll-up-your-sleeves approach to IP, commercial, and regulatory problems. He gains a deep understanding of his clients’ businesses and develops legal strategies to meet their goals. Unprompted client feedback led BTI to name Jayson a Client Service All-Star. He also applies his experience as SpaceX’s former Satellite Policy Director to space and telecom matters. That experience taught him to better understand what clients want from their outside counsel.
Before becoming a lawyer, Jayson earned a Ph.D. in applied physics and a bachelor’s degree in electrical engineering. He then developed and patented technology related to quantum cryptography, quantum computing, and optical communications at MagiQ Technologies and The MITRE Corporation. Using this training, Jayson has tackled legal matters involving technologies ranging from electronics and semiconductors to software and artificial intelligence to chemistry and life sciences, and he communicates complex concepts in a way judges, juries, arbitrators, and regulators can understand.
Jayson focuses his litigation practice on patents, trade secrets, copyrights, trademarks, IP licenses, technology development and collaboration agreements, and commercial contracts. He recently represented Planner 5D against Meta and Princeton in pursuing copyright and trade secret claims over scraped works used to train AI models. Before joining Bayla, Jayson led IP litigation teams at Paul, Weiss and Morrison & Foerster for sixteen years. He has litigated not only before many federal and state courts but also at the U.S. International Trade Commission, the U.S. Copyright Royalty Board, and JAMS and International Chamber of Commerce arbitrations.
Corporations and hedge funds have also turned to Jayson when they need sound judgment, thoughtful analysis, and careful drafting on transactional IP matters involving licensing, joint product development, IP ownership, acquisitions, investments, and securities offerings. Registered to practice before the United States Patent and Trademark Office, he has advised clients on patent prosecution and licensing programs, and has evaluated patent portfolios for acquisition, assertion, and freedom-to-operate.
Jayson counsels satellite operators, space startups, and investment firms on regulatory matters such as spectrum strategy and developments, space and earth station licensing, rulemakings, and coordination. At SpaceX, his written and oral advocacy at the FCC overcame technically complex, contentious challenges to secure major wins through license applications and rulemaking proceedings. He also headed spectrum coordination globally for Starlink, serving as SpaceX’s lead negotiator on spectrum sharing with satellite and terrestrial operators and with global regulatory agencies.
